Throughout the Site, the terms "we", "us" and "our" refer to Avora Brands LLC. By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By placing an order you confirm that you are legally able to enter into this agreement.

3. Products and descriptions

We try to describe and display our products, colors and sizes as accurately as possible. Colors may vary by screen, and sizing may vary by person; please use the size guide on each product page. We may change product descriptions, prices and availability at any time without notice and may limit quantities.

4. Health and wellness disclaimer

Our apparel products are intended for comfort, support and appearance. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Results vary by person. Customer testimonials reflect individual experiences and are not guarantees. Our dietary supplement products (such as gummies) have not been evaluated by the Food and Drug Administration. If you are pregnant, nursing, taking medication, have a medical condition or have circulation or skin concerns, consult a qualified healthcare professional before using our products.

5. Pricing and payment

All prices are shown in U.S. dollars unless stated otherwise at checkout. Payment is due at the time of purchase. We accept the payment methods shown at checkout, processed securely through our payment providers; we do not store your full card number. We may refuse or cancel any order, including orders that appear fraudulent, that contain pricing errors or that exceed stated quantity limits. If we cancel an order after payment, we will refund you in full.

6. Orders, shipping and returns

Shipping times and charges are described in our Shipping Policy. Our 90-Day Perfect Fit Guarantee and the terms for damaged or defective items are described in our Refund Policy, which is part of these Terms.

7. Promotions and discounts

Discount codes and promotions are subject to the terms shown with the offer, cannot be combined unless stated, have no cash value and may be changed or withdrawn at any time.

8. Accounts and accuracy of information

You agree to provide current, complete and accurate purchase and account information, and to keep your account credentials confidential. You are responsible for all activity under your account.

9. Intellectual property

All content on the Site, including text, graphics, logos, images, videos and product designs, is owned by or licensed to Avora Brands LLC and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use any content for commercial purposes without our written permission.

To the fullest extent permitted by law, Avora Brands LLC and its members, managers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or data, arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

You agree to indemnify and hold harmless Avora Brands LLC and its affiliates from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@mymaggies-tanks.com and give us 30 days to try to resolve the issue informally. Subject to any rights you cannot waive by law, any dispute not resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. The updated version is effective when posted on the Site, and the "Last updated" date shows when changes were made. Your continued use of the Site after changes means you accept them.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect.
